CHARTER PREFERRED CHECK CARD AGREEMENT
This agreement governs the use of your Charter National Bank automated teller machine ("ATM") and Charter Preferred Check Card. By applying for or using a Charter Preferred Check Card or by requesting a personal identification number ("PIN"), you promise to be bound by this Charter Preferred Check Card Agreement ("Agreement") and accept its terms, rules, and conditions as amended from time to time. All ATM, point-of-sale ("POS"), and Charter Preferred Check Card transactions are subject to applicable laws, regulations, rules and other agreements governing your Account as well as this Agreement. To understand all your rights and responsibilities, you must also read the Electronic Fund Transfers Disclosure, which will be sent to you with your Charter Preferred Check Card.
SERVICES AVAILABLE
Charter Preferred Check Cards- You can use your Charter Preferred Check
Card at all ATM or POS terminals bearing the Star® and Cirrus® logos,
including all Charter National Bank locations. You can also use your
Charter Preferred Check Card to make purchases and obtain cash advances
anywhere a Master Card is accepted. Each time you use your Charter
Preferred Check Card, the amount of the transfer is considered a
withdrawal from your checking account, even if the transaction is not
posted immediately to your account. You can not place a stop payment on
a Charter Preferred Check Card transaction.
At our discretion, we may not authorize subsequent ATM, POS, or Charter
Preferred Check Card transactions or pay items drawn on your account due
to outstanding Charter Preferred Check Card transactions. At our
discretion, we may allow transactions that exceed your available account
balance or available line of credit. If there is a negative balance in
your account, you agree to pay the overdraft and any overdraft charges.
LIMITATIONS ON SERVICES
Some ATM or POS services may not be available
at certain ATM or POS terminals and deposits can only be accepted at
Charter National Bank and Cash Station terminals.
You may only use your Charter Preferred Check Card for those ATM, POS
and Charter Preferred Check Card transactions you requested and we
approved. We reserve the right to restrict or to revoke use of your or
Charter Preferred Check Card for one or more types of accounts or
transactions. The Charter Preferred Check Card and PIN shall remain our
property, may be cancelled at any time without notice and must be
surrendered or destroyed upon our request. We may also terminate ATM,
POS, and Charter Preferred Check Card services at any time. Your Charter
Preferred Check Card will be cancelled if all of the checking accounts
linked to the card are closed.
Limits on the amount of cash that you may withdraw each day and the
dollar amount of goods that you may purchase are described in the
Electronic Fund Transfers Disclosure. All transactions are also limited
to the amount of the available funds in your account (plus any available
credit limit on your overdraft line of credit). We reserve the right to
change those limits and impose other limits or restrictions on your use
of the Charter Preferred Check Card.
We must authorize Charter Preferred Check Card access to each account.
USE OF CHARTER PREFERRED CHECK CARD, PIN, AND ATM OR POS TERMINALS
The Charter Preferred Check Card and PIN are provided solely for your use and protection and you agree at all times to:
a) safely keep the Charter Preferred Check Card and PIN separate and in your sole possession;
b) not disclose the PIN, record it on the Charter Preferred Check Card or otherwise make it available to anyone else; and
c) immediately report to us any loss, theft, disappearance or known or suspected unauthorized use of the Charter Preferred Check Card or the PIN
You are liable for all authorized Charter Preferred Check Card
transactions, and for all unauthorized transactions to the extent
permitted by applicable state and federal law.
The Charter Preferred Check Card and PIN shall remain our property, may
be cancelled at any time without notice and must be surrendered or
destroyed upon request. We may also terminate ATM, POS and Charter
Preferred Check Card services at any time.
ATM, POS AND CHARTER PREFERRED CHECK TRANSACTIONS
You authorize us without further inquiry to credit or charge your
account(s) for all deposits, withdrawals, purchases, transfers and
payments initiated through use of your Charter Preferred Check Card. You
also authorize us to charge your account(s) for the amount of any check
or other instrument for which you receive cash or credit through a
Charter Preferred Check Card transaction if that item is dishonored,
charged back or otherwise returned to us unpaid for any reason.
All ATM and POS transactions made on a non-business day or after the
cut-off time on a business day will be posted to your account as of our
next business day. All Charter Preferred Check Card transactions are
subject to receipt, verification and collection by us.
LIMITATIONS ON OUR RESPONSIBILITIES
Subject to requirements imposed by applicable law, we are not responsible or liable for any property loss or damage or other loss, injury, or harm, resulting directly or indirectly from (i) your misuse of an ATM or POS terminal; (ii) mechanical, electrical, or operational failure of an ATM or POS terminal or its support facilities; (iii) other circumstances reasonably beyond our control; (iv) an unintentional bona fide error by us in failing to make an ATM, POS, or Charter Preferred Check Card transfer despite procedures maintained by us reasonably adapted to avoid such errors; (v) insufficient cash at an ATM terminal to complete a transaction; (vi) failure to complete an ATM, POS or Charter Preferred Check Card transaction because (a) your account is subject to legal process or encumbrance, (b) your account has insufficient funds, (c) the transaction would cause you to exceed your credit limit, (d) your Charter Preferred Check Card has been cancelled or revoked, or (e) your account has been terminated or closed.
DISPUTES
We are not liable for any claims that you may have against a merchant in connection with any POS or Charter Preferred Check Card transaction.
AMENDMENT OF TERMS
We may change the terms of this Agreement at any time. The change will be effective immediately if necessary for security reasons; otherwise upon posting notice of the change in our lobbies or, at our option, by our mailing notice of the change to you at your address shown on our records.
GENERAL
This Agreement shall be governed by applicable state and federal laws
and regulations. The invalidity of any provision of this Agreement shall
not affect other provisions. Your accounts with us are also governed by
the terms and conditions contained in our brochure titled Important
Information About Deposit Accounts, which you may obtain by calling or
going to one of our branches.
You agree to pay all service charges for the use of a Charter Preferred
Check Card as set forth in our Service Charge Schedule and any expenses,
costs and fees relating to any Charter Preferred Check Card transaction
or enforcement of this Agreement. This includes reasonable attorneys'
fees (including the cost of any attorney employed by us) and legal
expenses, subject to limitations imposed by federal or state law.
This Agreement is binding upon you, your heirs, personal
representatives, successors and assigns. If more than one person has
signed the Charter Preferred Check Card application or the signature
card(s) for the account(s) accessed by the Charter Preferred Check Card,
each person so signing is jointly and severally liable, whether or not
more than one person uses the Charter Preferred Check Card. The Bank may
act on the instructions or orders of any authorized user.
SECURITY TIPS FOR USING YOUR ATM AND CHARTER PREFERRED CHECK CARD
With the ease and convenience of ATMs also comes the need to use caution
and a bit of safety-sense when making ATM transactions.
To protect yourself and your card:
- Sign your card upon receipt.
- Memorize your pin and don't share the number with anyone.
- After dark, choose an ATM that is well lit and be accompanied by another person.
- Put your cash away immediately and count it later once you are securely in your car or home.
- Seek another machine or return at a later time if you see anything suspicious when considering using an ATM.
- Save all receipts. Never throw them in the trash or on the ground, and verify each against your bank statement.
- Report all crimes immediately to the operator of the ATM or local law enforcement officials.
